General Conditions of Purchase
The content of this contract shall apply to every on-line purchase through website www.sensation-seeds.nl owned by Aveke Barcelona S.L. (hereinafter the Provider). The acceptance of the present document will imply that the user: Has read, understands and comprehends the content of this document. Has the sufficient capacity to contract. Accepts all the obligations set forth herein. Has reached the legal age. These conditions shall be valid indefinitely and applicable to every on-line purchase through this website. The provider reserves the right to unilaterally modify the aforementioned conditions, without prejudice to the goods or promotions previously purchased. The confirmation of the user’s legal age will always be necessary. Otherwise, no transaction will be carried out and the user will be asked to leave the website.

Subject of the contract
The purpose of this contract is the regulation of the sales relationship between Aveke S.L. and the user after accepting the corresponding box during the purchasing process. The contractual relationship emanating from the purchase entails the delivery of a particular product, in exchange for an agreed price published on the website.
Both parties attest these general conditions of purchase, excepting other special conditions specifically agreed. Sensation Seeds warranties the quality of their seeds with a 90% warranty for genetics. Because of their organic origin and nature, the company cannot be held 100% responsible for the use and maintenance of the products, as well as the conservation and germination processes carried out by the client. The seed stock is strictly controlled, and fast and constantly renewed respecting the cure periods. Moreover, Sensation Seeds carries out germination tests regularly and only releases the absolutely warranted results. Although, as indicated before, seeds are alive products, therefore once the product leaves our warehouse, the germination power cannot be 100% warranted. Cannabis seeds can only be germinated in those countries where it is permitted by Law. It is the client responsibility to enquire about the local law and act accordingly. Thus, under no circumstances would Sensation Seeds be liable for any shipment seized by customs or similar entities. Contact your domestic institutions for more information. Sensation Seeds will not be liable for third-party illegal misuse of our products.
Orders will be delivered in the address freely designated by the user. Deliveries will be made by couriers or mail services, and delivery time will vary depending upon the location of the delivery. The Provider shall not be responsible or liable when deliveries could not reach their destination because the information provided by the user is incorrect, inaccurate or incomplete; or if this happens though, no fault of the shipping company allocated for this purpose, such as the absence of the recipient. The delivery times and availability are approximate and may vary according to different factors such us the product nature, destination zone, the number of units, the payment terms, delivery problems, stock-outs, etc. Without limiting the foregoing, the provider shall not be held responsible when taking the measures required of diligent retailers to make the delivery in due time, or as soon as possible. In the event of failure to perform the contract when the goods or services hired were not available, the user should be duly informed and able to be refunded of any sums of money previously paid as soon as possible or in any case within a maximum of 30 days. In the event that the goods or services ordered were not available, having been expressly informed of such a possibility, the provider shall be able to provide a product or service of equal or superior quality, as long as they do not result in a price increase. In accordance with Legislative Royal Decree 1/2007, of 16 November, passing the consolidated text of the general Law for the Protection of Consumers and Users; in case the supplier fails to perform the contract on the grounds that the goods or services ordered are unavailable, the consumer and user must be informed of the situation and shall be able to obtain a refund of any sums paid as soon as possible and in any case within a maximum of 30 days.
Price and shipping fees
The price shall be the one indicated in the product description including VAT, and it will be the final price of the product. Shipping fees will be communicated once submitted the delivery address and will be automatically displayed on the website. Orders over €25 will be sent with no additional shipping costs, a flat-rate of €6 will be charged on those under €25. The customer accepts that the price of some products may vary in real time; nevertheless, it will always be communicated in advance to the user. Web clients will accumulate points for their purchases which could be traded in for products or rewards.
To complete a payment there are several available option: Bank Transfer.
*Bank transfer: The total cost of the products will be paid in advance to the bank account provided throughout order processing. Once received, the shipment will take place. The following is the account number:

Once the payment term has been confirmed (immediately, in case of credit card payments), the parcel will be prepared to be picked up by the transport agency. Parcels are generally sent twenty-four hours after the payment has been confirmed. Shipping fees include packaging, handling and delivery services.
Right of withdrawal
The user shall have a period of 14 days after receiving the product to return it back. The cost of product will be refunded after verifying that no manipulation of the product has occurred and the packaging is original. Otherwise, no refund will be made. Returns will only be accepted in their original packaging and without any signs of tampering. Tampered goods or those in poor condition will not be refunded. Return expenses will be covered by the consumer. Furthermore, when a seed failure occurs and it is not attributable to the user (problems with germination or beyond the germination process itself), the deadline for return will be 14 days after contacting Sensation Seeds. According to our technician’s criteria and approval after careful consideration of each particular case, a new seed will be sent. Replacement costs, once approved by the technician, will be covered by the company.
Applicable law and jurisdiction
In order to solve any disputes related to this website or the activities carried out on it, Spanish legislation will be applicable, and the parties expressly agree to submit to the aforementioned. The Courts of Granada will be competent for the resolution of any conflicts arising or related to the use of this website. All the aforementioned conditions shall be governed and construed in accordance with Spanish legislation, regarding any issue not expressly set forth herein. The provider and the user, accept the jurisdiction of the Courts of Granada for the resolution of any disputes that may arise from the provision of products and services subjected to these conditions. Likewise, the provider and the user shall subject their conflicts to the arbitration provided in the Arbitration, Consumer and User Defence legislation, or any other out-of-court alternative dispute resolution systems established in codes of practice and other self-regulatory instruments.
